Newly-released evidence shows what helped clear a Georgia police officer in the shooting death of a teenager.
EUHARLEE, Ga. -- Newly-released evidence shows what helped clear a Georgia police officer in the shooting death of a teenager.
Last week, a second grand jury ruled against indicting Euharlee officer Beth Gatny with any wrongdoing in the death of 17-year-old Chris Roupe.
The family has said Chris was holding a Wii remote and not a weapon when Gatny was trying to serve a warrant involving the teen's father.
GBI recordings explain what the officer says she encountered that day. In the recordings, the officer told investigators she didn't notice the orange tip on the toy gun until after she pulled her trigger.
"I went up on the porch and knocked on the door," Gatny said in the recording. "I heard somebody approach the door and it sounded like they racked a gun. The door opened and there's this guy standing there with a gun pointed at my face, and his hand clenched, so I think he had...And by that time, I had pulled out my gun and I thought he had shot me and I returned fire."
The GBI photographed two AirSoft toy guns in the home. They were found near the couch.
By law, all toy guns have to have orange tips, in part so you can distinguish them from the real thing.
